Understanding the Rules of Evidence within Parental Alienation Cases:
with Theodore F. Greene, LC
Audio File - AV111
Have you been to court with what you feel is vital information for the Judge to see that you are sure would crack open your Parental Alienation case, only to find that it was not admitted into evidence and therefore not heard?
Have you ever been disappointed to learn that a critically important hand written note that clearly exposes the alienator, is not admitted into evidence or heard by the Judge due the Hearsay rule?
These Rules of Evidence are the “filters” through which the actual events which occur within a given case may either be presented in court as Evidence or prevented from being heard by the Judge for not achieving evidentiary standards. These Rules are based in Federal Statute, all States having their own version of them, which correspond closely to the Federal Rules. These are the rules that determine if the Judge will hear a recording of an alienating parent engaged in alienating behavior or not. These are the Rules that are used by Judges when they either sustain, or overrule an attorney’s objection. These are the Rules that determine who may be deposed and how and when and who may not. The list goes on.
Any non-attorney who has attempted to understand these Rules is likely to leave the attempt confused and no more enlightened. This course is a rare opportunity to have the playbook of the Rules of Evidence - especially as they often come to bear in cases of Parental Alienation - exposed and explored. We are very fortunate to have a well known Family Lawyer, with whom I have worked on many occasions, sit down and explain in laymen’s terms, how and why the Rules of Evidence operate as they do. Theodore F. Green, Esq., known as Ted to his clients, is an experienced Family Lawyer, who happens to also be a gifted and natural teacher. He has a masterful way of making the intricacies of complex legal topics understandable and therefore useful.
The goal of this course is to make these concepts understandable to you - the parent who finds them self in Family Court with a Parental Alienation case - and therefore usable by you in your case. In addition to being a natural teacher, Ted is also very experienced regarding Parental Alienation, and special emphasis is given to how the Rules often come into play in these cases.
The format of the course is that of interview and dialogue with myself conducting the interview and asking questions. I believe that you will find this course to be very rich in content, such that it will be listened to many times, taking notes all the while. There is much here to absorb. I am frankly aware of no other such resource that addresses this important topic so directly. I am very excited to be able to offer it, and very appreciative to Ted for taking the time to speak with us about this.
